Privacy is one of the most quickly developing areas of law. BLM was involved in the case of McKennitt v Ash in which judgment was given by the Court of Appeal in December 2006 and which is currently the leading decision on the application of the law of privacy to ‘kiss and tell’ publications from tabloid newspapers to the publishers of biographies. These developments affect everything from the use of photographs in newspaper articles to the publication of such biographies.
